How the Workers’
Compensation Process Works

After sustaining a workplace injury, your first step should always be to seek medical attention as soon as practicable.

Next, you will need to notify your employer of your injuries and your intent to file a workman’s comp claim. Specifically, you must provide this notice within 90 days of your injury. Failure to do so within this timeframe can result in disqualification from receiving any workers’ compensation benefits at all.

Finally, you’ll need to file a Form 50 workplace injury claim form with the South Carolina Workers’ Compensation Commission (WCC). While employers will often file a claim with the WCC after a workplace accident, the injured worker should also do so within two years after the incident to protect their right to compensation.

So what do you do if your claim is denied?

Fortunately, there are a few options available. For example, you can use the same Form 50 to request a hearing with the WCC, which will hear testimony and evidence regarding the claim. If your denial is sustained even after this hearing, you can also make a formal appeal before the WCC.
